Plate Gains Terms of Service
Effective date: October 28, 2026
These terms are an agreement between you and Aidan R Sethen ("we", "us"), the developer of Plate Gains. By creating an account or using the app, you agree to them and to our Privacy Policy. If you don't agree, please don't use Plate Gains.
Who can use Plate Gains
You must be 18 or older. Give accurate information when you set up your profile, keep your password private, and use your own account only. You're responsible for what happens in your account.
Not medical advice
Plate Gains gives general fitness and nutrition information. It is not medical advice, diagnosis or treatment, and it doesn't replace a doctor, registered dietitian or other qualified professional.
- Talk to a doctor before starting any diet or exercise program, especially if you have a health condition, take medication, are pregnant or have a history of an eating disorder.
- Stop exercising and get medical help if you feel pain, chest pain, dizziness or shortness of breath.
- Never ignore or delay professional advice because of something in the app.
Exercise at your own risk
Exercise carries a risk of injury. You decide whether to do each exercise and how much weight to use, and you're responsible for using equipment safely, using good form and exercising in a safe place. Exercise demonstrations are illustrations, not coaching.
AI features can be wrong
Nutrition-label reading, meal-photo estimates and meal plans are produced by AI (Anthropic's Claude). The AI can misread a label, misjudge a portion, get nutrition numbers wrong or suggest a food that doesn't suit you. Meal plans are checked against your allergies with a simple keyword check that can miss hidden ingredients. Always check the numbers and ingredients yourself before relying on them, and don't rely on the app to keep you safe from an allergy.
Food data
Food search and barcode results come from Open Food Facts, a database built by volunteers. It can be incomplete or wrong, so check important values against the package. Food data from Open Food Facts (openfoodfacts.org), available under the Open Database License (ODbL).
Your data
You own the information you put into Plate Gains. You allow us to store and process it only to run the app for you, as described in the Privacy Policy.
Acceptable use
Don't misuse Plate Gains. For example, don't try to break into, overload or reverse-engineer the app or its servers, get around daily limits, use automated tools to access it, use someone else's account, or use the app for anything illegal.
Ending your account
You can delete your account at any time in Settings. We may suspend or close an account that breaks these terms or misuses the service, or when the law requires it, and we'll tell you when we reasonably can. We may change, pause or stop parts of the app.
Subscriptions
Plate Gains' core features are free. The free version may show ads, which are provided by Google AdMob and described in the Privacy Policy. Plate Gains Premium is an optional subscription that adds AI meal plans and meal photo estimates and removes ads. If you subscribe:
- You buy through the App Store or Google Play, and the price, billing period and any free trial are shown before you confirm.
- A free trial turns into a paid subscription when it ends unless you cancel at least 24 hours before.
- Subscriptions renew automatically until you cancel. Cancel at least 24 hours before the renewal date in your App Store or Google Play subscription settings. Deleting the app or your account doesn't cancel a subscription.
- Refunds are handled by Apple or Google under their own policies.
- We'll give notice of price changes as the stores require.
No warranty
Plate Gains is provided "as is" and "as available". To the extent the law allows, we make no promises of any kind about the app, including that it will be accurate, suit your needs, be available without interruption or be free of errors.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any injury, illness or loss that results from using the app, following its plans or exercises, or relying on its nutrition information or AI estimates. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and 100 Canadian dollars. Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer that can't be waived.
Indemnity
To the extent the law allows, you agree to cover our reasonable costs if a claim is brought against us because you broke these terms or misused the app.
Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and disputes go to the courts of British Columbia. If you live elsewhere, you keep any protections your local consumer law gives you that can't be waived.
Changes to these terms
We may update these terms. We'll change the effective date above, and for significant changes we'll tell you in the app before they apply. If you keep using Plate Gains after a change takes effect, you accept the new terms.
General
These terms and the Privacy Policy are the whole agreement between you and us about Plate Gains. If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it. You can't transfer these terms to someone else; we may transfer them if the app is sold or transferred.
